Fighting downtown blight with economic incentives | AKT Peerless

Vibrant downtown areas are a critical component of our local economies. Faced with a growing number of vacant properties in these key commercial districts, Michigan?s city, township, and county officials are leveraging powerful economic incentives to fight downtown blight in their communities.

After assuming ownership of a vacant building in a prime downtown location, the City of Saginaw recently elected to redevelop the 60,000 square foot property. Unfortunately, the former retail space contained dangerous building materials such as PCBs, lead, and asbestos. The presence of these materials increased the cost of demolition considerably.

With limited time and resources available, the city of Saginaw explored additional financing methods. Due to our extensive redevelopment experience, AKT Peerless was retained to help secure funding and provide environmental and economic development consulting services.

To help fund this project, we leveraged Tax Increment Financing (TIF) incentives, a method by which the future increases in property tax revenues are used to finance project activities. TIF is a powerful financing tool that local communities can use to boost economic development without experiencing a loss to any taxing jurisdiction.

By employing the TIF incentives offered by the Downtown Development Authority and the Brownfield Redevelopment Authority, we were able to secure over $850k for Saginaw?s redevelopment project.This is just one example of how Michigan?s local governments are leveraging economic incentives to revitalize their community infrastructure.

Considering a similar project?

What Mitt Romney will say: ?I wish President Obama had succeeded?

TAMPA ? The Mitt Romney campaign says these paragraphs below are excerpts of tonight?s speech, in which he?ll accept the GOP nomination for president ? but they look to be the bulk of his remarks.

Not many specifics, no direct attacks on President Barack Obama ? he also gives Michelle Obama a mention. Some mention of his church life. The most personal revelation is his dad?s support for his mom when she ran for U.S. Senate in Michigan.

And he embraces his years at Bain. To wit:

Four years ago, I know that many Americans felt a fresh excitement about the possibilities of a new president. That president was not the choice of our party but Americans always come together after elections. We are a good and generous people who are united by so much more than divides us.

When that hard fought election was over, when the yard signs came down and the television commercials finally came off the air, Americans were eager to go back to work, to live our lives the way Americans always have ? optimistic and positive and confident in the future.

That very optimism is uniquely American.

It is what brought us to America. We are a nation of immigrants. We are the children and grandchildren and great-grandchildren of the ones who wanted a better life, the driven ones, the ones who woke up at night hearing that voice telling them that life in that place called America could be better.

They came not just in pursuit of the riches of this world but for the richness of this life.

***

Every family in America wanted this to be a time when they could get ahead a little more, put aside a little more for college, do more for their elderly mom who?s living alone now or give a little more to their church or charity.

Every small business wanted these to be their best years ever, when they could hire more, do more for those who had stuck with them through the hard times, open a new store or sponsor that Little League team.

Every new college graduate thought they?d have a good job by now, a place of their own, and that they could start paying back some of their loans and build for the future.

This is when our nation was supposed to start paying down the national debt and rolling back those massive deficits.

This was the hope and change America voted for.

***

I wish President Obama had succeeded because I want America to succeed. But his promises gave way to disappointment and division. This isn?t something we have to accept. Now is the moment when we CAN do something. With your help we will do something.

Now is the moment when we can stand up and say, ?I?m an American. I make my destiny. And we deserve better! My children deserve better! My family deserves better. My country deserves better!?

So here we stand. Americans have a choice. A decision.

To make that choice, you need to know more about me and about where I will lead our country.

***

My mom and dad gave their kids the greatest gift of all ? the gift of unconditional love. They cared deeply about who we would BE, and much less about what we would DO.

Unconditional love is a gift that Ann and I have tried to pass on to our sons and now to our grandchildren. All the laws and legislation in the world will never heal this world like the loving hearts and arms of mothers and fathers. If every child could drift to sleep feeling wrapped in the love of their family ? and God?s love? this world would be a far more gentle and better place.

***

My mom and dad were true partners, a life lesson that shaped me by everyday example. When my mom ran for the Senate, my dad was there for her every step of the way. I can still hear her saying in her beautiful voice, ?Why should women have any less say than men, about the great decisions facing our nation??

I wish she could have been here at the convention and heard leaders like Governor Mary Fallin, Governor Nikki Haley, Governor Susana Martinez, Senator Kelly Ayotte and Secretary of State Condoleezza Rice.

As Governor of Massachusetts, I chose a woman Lt. Governor, a woman chief of staff, half of my cabinet and senior officials were women, and in business, I mentored and supported great women leaders who went on to run great companies.

***

Like a lot of families in a new place with no family, we found kinship with a wide circle of friends through our church. When we were new to the community it was welcoming and as the years went by, it was a joy to help others who had just moved to town or just joined our church. We had remarkably vibrant and diverse congregations of all walks of life and many who were new to America. We prayed together, our kids played together and we always stood ready to help each other out in different ways.

And that?s how it is in America. We look to our communities, our faiths, our families for our joy, our support, in good times and bad. It is both how we live our lives and why we live our lives. The strength and power and goodness of America has always been based on the strength and power and goodness of our communities, our families, our faiths.

***

When I was 37, I helped start a small company. My partners and I had been working for a company that was in the business of helping other businesses.

So some of us had this idea that if we really believed our advice was helping companies, we should invest in companies. We should bet on ourselves and on our advice.

***

That business we started with 10 people has now grown into a great American success story. Some of the companies we helped start are names you know. An office supply company called Staples ? where I?m pleased to see the Obama campaign has been shopping; The Sports Authority, which became a favorite of my sons. We started an early childhood learning center called Bright Horizons that First Lady Michelle Obama rightly praised. At a time when nobody thought we?d ever see a new steel mill built in America, we took a chance and built one in a corn field in Indiana. Today Steel Dynamics is one of the largest steel producers in the United States.

***

But for too many Americans, these good days are harder to come by. How many days have you woken up feeling that something really special was happening in America?

Many of you felt that way on Election Day four years ago. Hope and Change had a powerful appeal. But tonight I?d ask a simple question: If you felt that excitement when you voted for Barack Obama, shouldn?t you feel that way now that he?s President Obama? You know there?s something wrong with the kind of job he?s done as president when the best feeling you had, was the day you voted for him.

***

Today the time has come for us to put the disappointments of the last four years behind us.

To put aside the divisiveness and the recriminations.

To forget about what might have been and to look ahead to what can be.

Now is the time to restore the Promise of America. Many Americans have given up on this president but they haven?t ever thought about giving up. Not on themselves. Not on each other. And not on America.

What is needed in our country today is not complicated or profound. It doesn?t take a special government commission to tell us what America needs.

What America needs is jobs.

Lots of jobs.

***

To the majority of Americans who now believe that the future will not be better than the past, I can guarantee you this: if Barack Obama is re-elected, you will be right.

I am running for president to help create a better future. A future where everyone who wants a job can find one. Where no senior fears for the security of their retirement. An America where every parent knows that their child will get an education that leads them to a good job and a bright horizon.

And unlike the president, I have a plan to create 12 million new jobs. It has 5 steps.

First, by 2020, North America will be energy independent by taking full advantage of our oil and coal and gas and nuclear and renewables.

Second, we will give our fellow citizens the skills they need for the jobs of today and the careers of tomorrow. When it comes to the school your child will attend, every parent should have a choice, and every child should have a chance.

Third, we will make trade work for America by forging new trade agreements. And when nations cheat in trade, there will be unmistakable consequences.

Fourth, to assure every entrepreneur and every job creator that their investments in America will not vanish as have those in Greece, we will cut the deficit and put America on track to a balanced budget.

And fifth, we will champion SMALL businesses, America?s engine of job growth. That means reducing taxes on business, not raising them. It means simplifying and modernizing the regulations that hurt small business the most. And it means that we must rein in the skyrocketing cost of healthcare by repealing and replacing Obamacare.

***

President Obama promised to slow the rise of the oceans and to heal the planet. MY promise?is to help you and your family.

***

We will honor America?s democratic ideals because a free world is a more peaceful world. This is the bipartisan foreign policy legacy of Truman, and Reagan. And under my presidency we will return to it once again.

***

The America we all know has been a story of the many becoming one, uniting to preserve liberty, uniting to build the greatest economy in the world, uniting to save the world from unspeakable darkness.

Everywhere I go in America, there are monuments that list those who have given their lives for America. There is no mention of their race, their party affiliation, or what they did for a living. They lived and died under a single flag, fighting for a single purpose. They pledged allegiance to the UNITED States of America.

That America, that united America, can unleash an economy that will put Americans back to work, that will once again lead the world with innovation and productivity, and that will restore every father and mother?s confidence that their children?s future is brighter even than the past.

That America, that united America, will preserve a military that is so strong, no nation would ever dare to test it.

That America, that united America, will uphold the constellation of rights that were endowed by our Creator, and codified in our constitution.

That united America will care for the poor and the sick, will honor and respect the elderly, and will give a helping hand to those in need.

That America is the best within each of us. That America we want for our children.

If I am elected President of these United States, I will work with all my energy and soul to restore that America, to lift our eyes to a better future. That future is our destiny. That future is out there. It is waiting for us. Our children deserve it, our nation depends upon it, the peace and freedom of the world require it. And with your help we will deliver it. Let us begin that future together tonight.

Everything Everywhere signs 5year deal with MasterCard for mobile payments

MasterCard has switched up its NFC and Mobile Payments deal with T-Mobile and Orange to include corporate parent / sibling Everything Everywhere. The pairing will leverage the existing Orange Cash standard to get users onto the service, building out a person-to-person payment system similar to Pingit as they go. It's reportedly angered rival networks Vodafone and O2, still smarting from last week's 4G news, who were co-operating on a unified mobile payments service called "Project Oscar" that would have standardized the system nationwide. Given that Vodafone has partnered with Visa and O2 is trying things out on its own, perhaps the next time you choose a phone, you'll have to side with your card-provider of choice, too.

Correction: Mars-Music story

PASADENA, Calif. (AP) ? In a story Aug. 28 about music broadcast from Mars, The Associated Press reported erroneously that the new song from will.i.am traveled 700 million miles based on information from NASA. The distance should be 330 million miles.

A corrected version of the story is below:

New will.i.am song 'Reach for the Stars' broadcast from Mars

PASADENA, Calif. (AP) ? Will.i.am has premiered his new single ? from Mars.

The NASA rover Curiosity beamed to Earth his new song "Reach for the Stars" on Tuesday in the first music broadcast from another planet, to the delight of students who gathered at the Jet Propulsion Laboratory to listen.

The song had been uploaded to the rover, which landed near the equator of Mars, and played back ? a journey of some 330 million miles.

The musician, who promotes science and mathematics education, was among more than a dozen celebrities who were invited to JPL to watch Curiosity's landing earlier this month. Others included Wil Wheaton, Seth Green and Morgan Freeman.

In 2008, NASA beamed the Beatles' "Across the Universe" into the cosmos to commemorate the 40th anniversary of the song.

NASA's Kepler discovers multiple planets orbiting a pair of stars

ScienceDaily (Aug. 28, 2012) ? Coming less than a year after the announcement of the first circumbinary planet, Kepler-16b, NASA's Kepler mission has discovered multiple transiting planets orbiting two suns for the first time. This system, known as a circumbinary planetary system, is 4,900 light-years from Earth in the constellation Cygnus.

This discovery proves that more than one planet can form and persist in the stressful realm of a binary star and demonstrates the diversity of planetary systems in our galaxy.

Astronomers detected two planets in the Kepler-47 system, a pair of orbiting stars that eclipse each other every 7.5 days from our vantage point on Earth. One star is similar to the sun in size, but only 84 percent as bright. The second star is diminutive, measuring only one-third the size of the sun and less than 1 percent as bright.

"In contrast to a single planet orbiting a single star, the planet in a circumbinary system must transit a 'moving target.' As a consequence, time intervals between the transits and their durations can vary substantially, sometimes short, other times long," said Jerome Orosz, associate professor of astronomy at San Diego State University and lead author of the paper. "The intervals were the telltale sign these planets are in circumbinary orbits."

The inner planet, Kepler-47b, orbits the pair of stars in less than 50 days. While it cannot be directly viewed, it is thought to be a sweltering world, where the destruction of methane in its super-heated atmosphere might lead to a thick haze that could blanket the planet. At three times the radius of Earth, Kepler-47b is the smallest known transiting circumbinary planet.

The outer planet, Kepler-47c, orbits its host pair every 303 days, placing it in the so-called "habitable zone," the region in a planetary system where liquid water might exist on the surface of a planet. While not a world hospitable for life, Kepler-47c is thought to be a gaseous giant slightly larger than Neptune, where an atmosphere of thick bright water-vapor clouds might exist.

"Unlike our sun, many stars are part of multiple-star systems where two or more stars orbit one another. The question always has been -- do they have planets and planetary systems? This Kepler discovery proves that they do," said William Borucki, Kepler mission principal investigator at NASA's Ames Research Center in Moffett Field, Calif. "In our search for habitable planets, we have found more opportunities for life to exist."

To search for transiting planets, the research team used data from the Kepler space telescope, which measures dips in the brightness of more than 150,000 stars. Additional ground-based spectroscopic observations using telescopes at the McDonald Observatory at the University of Texas at Austin helped characterize the stellar properties. The findings are published in the journal Science.

"The presence of a full-fledged circumbinary planetary system orbiting Kepler-47 is an amazing discovery," said Greg Laughlin, professor of Astrophysics and Planetary Science at the University of California in Santa Cruz. "These planets are very difficult to form using the currently accepted paradigm, and I believe that theorists, myself included, will be going back to the drawing board to try to improve our understanding of how planets are assembled in dusty circumbinary disks."

Ames manages Kepler's ground system development, mission operations and science data analysis. NASA's Jet Propulsion Laboratory in Pasadena, Calif., managed the Kepler mission development.

Ball Aerospace & Technologies Corp. in Boulder, Colo., developed the Kepler flight system and supports mission operations with the Laboratory for Atmospheric and Space Physics at the University of Colorado in Boulder.

The Space Telescope Science Institute in Baltimore archives, hosts and distributes Kepler science data. Kepler is NASA's tenth Discovery Mission and funded by NASA's Science Mission Directorate at the agency's headquarters in Washington.

Family of alleged shooter 'horrified'

PERRY HALL, Md. (AP) ? The father of a 15-year-old student who police say shot another student at a Baltimore County high school says his son was bullied.

The father spoke to a reporter at his home Monday evening and said his son was the shooter. The Associated Press is not identifying the teen or his family because he is a juvenile and has not been charged.

A woman who was also at the home and said she was related to the father, gave the following statement on the family's behalf: "We are horrified. We did not see this coming and our thoughts and prayers are with the victim and the victim's family."

When asked about a motive for the shooting, the father indicated his son had been bullied. He gave no further details.

Romney assails Obama campaign on Akin, abortion

TAMPA, Fla. (AP) ? Mitt Romney accused President Barack Obama's campaign of trying to link him to Rep. Todd Akin's statements about rape and abortion, calling that a sad new low in the bitter election race while conceding that controversy over the remarks is hurting the Republican Party.

Romney's comments were broadcast Sunday as Republicans poured into Florida prepared to cram four days of nominating convention events into three because of the threat caused by Tropical Storm Isaac.

Railing about a Democratic campaign they cast as harshly negative ? as the Democrats say about the GOP ? Romney and Republicans sought to reach out to female voters and Hispanics ? two voting blocs that polls show favor Obama. Top Republicans said it was crucial that the party broaden its appeal for the November election and for longer-term political viability.

Akin's remarks dogged the GOP as delegates and party officials gathered in this Florida city nervously eyeing overcast skies for the impending storm. Republicans scrambled to reconfigure their schedule, postponing the bulk of events that had been scheduled for Monday's opening.

Akin is the GOP Missouri Senate candidate who said women's bodies have ways of avoiding pregnancy from a "legitimate" rape. Romney and other GOP leaders have criticized those statements and urged Akin to drop out of the Senate race.

Asked in an interview, recorded earlier, on "Fox News Sunday" about what the questioner said were Obama campaign efforts to link Akin's remarks to Romney and other Republicans, Romney said: "It really is sad, isn't it, with all the issues that America faces for the Obama campaign to continue to stoop to such a low level."

Romney said the controversy over Akin "hurts our party and I think is damaging to women."

He said that as Massachusetts governor, he had helped women by guaranteeing coverage for them ? and men as well ? by enacting that state's health care legislation. Romney has pledged that as president he would repeal Obama's health care overhaul law ? which is similar to the Massachusetts statute ? but Romney said he was proud of his accomplishment at the state level.

Obama hasn't explicitly linked Romney to Akin, but he said in an interview with The Associated Press that the GOP candidate has locked himself into "extreme positions" on economic and social issues and would surely impose them if elected president.

In a Web ad, the Democratic National Committee spliced together images of Romney and Paul Ryan, Akin's interview in which he made the comments and various news reports, with the question, "Where does the GOP stand on the issue of women's health?"

The ad's final image is the Romney-Ryan campaign logo with Akin's name added.

The Democratic Party, in fundraising appeals, has sought to tie the Romney-Paul Ryan ticket to Akin.

"Now, Akin's choice of words isn't the real issue here. The real issue is a Republican Party ? led by Mitt Romney and Paul Ryan ? whose policies on women and their health are dangerously wrong," said a recent letter from Debbie Wasserman Schultz, the chairwoman of the Democratic Party.

Separately, Republican National Party Chairman Reince Priebus said Akin's insistence on staying in the Missouri Senate race could cost the party its chance to win control of the Senate.

Priebus said Akin "should put the mission of liberty and freedom ahead of himself" and leave the race.

Akin has ignored calls from national GOP leaders to leave the race against incumbent Democratic Sen. Claire McCaskill. Republicans hope to pick off her seat and capture a Senate majority in the November elections. Priebus commented Sunday on CNN's "State of the Union."

On the eve of the convention, the Romney campaign released a new ad using Obama's words on Medicare cuts from the 2008 campaign. The ad, with the catchphrase, "It ain't right," criticizes the $700 billion in Medicare cuts in Obama's health care law.

Meanwhile, Sen. John McCain, R-Ariz., said Romney must effectively reach women and Hispanics if he is to oust Obama in the November election.

Speaking on NBC's "Meet the Press," the former GOP presidential candidate said Romney must convince women and Hispanics that "jobs and the economy are more important perhaps than other issues."

Former Florida GOP Gov. Jeb Bush had a similar message about the Hispanic vote, saying on NBC, "Gov. Romney can make inroads if he focuses on how do we create a climate of job creation and economic growth."

Bush, who has long urged his party to craft a more conciliatory message to Hispanics, added: "We've got to have a better tone going forward over the long haul for sure. You can't ask people to join your cause and then send a signal that 'you're really not wanted.' It just doesn't work."

As aides in Tampa scrambled, Romney was taking a rare day off the campaign trail at his lakeside vacation home in New Hampshire, receiving updates on the storm and making final preparations for the Thursday speech with which he will accept his party's presidential nomination. The campaign said he was working with a teleprompter.

"The safety of those in Isaac's path is of the utmost importance," Romney tweeted after Republican officials announced Saturday that they had postponed almost all of Monday's convention proceedings until Tuesday.

Though the storm appeared to be on a track that would pass well west of Tampa, storm surges and flooding from Isaac were still possible, and convention organizers said they were making contingency plans to move delegates who had been booked into beachfront hotels to other locations if necessary. They indicated the schedule shift also was meant to prevent overburdening emergency response personnel at the height of the storm.

The Republican Party planned to break from the political speeches to honor astronaut Neil Armstrong with a video tribute. Armstrong died Saturday.

Convention spokesman James Davis said the GOP's advice to delegates was "if your travel plans have not been interrupted and they're set, we recommend you come on down."

With Isaac nearing, Obama, who had been at the Camp David presidential retreat in Maryland, dispatched the Federal Emergency Management Agency to establish a command center and move more resources into the state. Vice President Joe Biden scrapped a planned campaign trip into Florida that was to counter the start of the GOP convention.

Republicans hope to use this week's convention to cast Romney as a determined leader with the know-how to fix the country's economy. They also want to introduce him as a family figure to counter the image of him as a ruthless businessman as Democrats have sought to brand him.

The convention gives the GOP the opportunity to send a message of unity roughly two months before the election. But onetime presidential candidate Rep. Ron Paul signaled that he wasn't onboard.

In an interview with The New York Times, the Texas congressman said convention officials had said he could speak at the event if he allowed the Romney campaign to review his remarks beforehand and if he delivered a full-throated endorsement of the candidate.

"It wouldn't be my speech," Paul said. "That would undo everything I've done in the last 30 years. I don't fully endorse him for president."

Paul was anticipating thousands at a University of South Florida rally on Sunday.

Obama was due to travel next week to college towns in Iowa, Colorado and Virginia to court young voters. The president's nomination for a second term is to come next week in Charlotte, N.C.

The Democrat picked up the endorsement of former Florida Gov. Charlie Crist, the Republican-turned-independent who lost the 2010 Senate race to Republican Marco Rubio.

In an article in the Tampa Bay Times, Crist called Obama the "right leader" for the state and the country. He criticized what he said was his former party's move to the right, saying it "has failed to demonstrate the kind of leadership or seriousness voters deserve."

A few of Romney's former presidential rivals were holding events of their own in Tampa. Herman Cain and Minnesota Rep. Michele Bachmann ? both have endorsed Romney ? were appearing at a joint event.

As first reported by CBS Sports? Jon Heyman, the Orioles have acquired lefty starter Joe Saunders in a waiver trade from Arizona. Matt Lindstrom, a right-handed reliever, is headed to the Diamondbacks in return along with a player to be named later.

The 31-year-old has posted a decent 4.22 ERA and 1.36 WHIP in 130 innings this season, but the D?Backs have a number of young arms in their system and did well to land a reliable setup man in their return?package from the O?s.

Lindstrom, 32, registered a 2.72 ERA and 1.29 WHIP across 36 1/3 innings this year for Baltimore.

Saunders will be eligible for free agency this offseason. He?s earning $6 million in his final year of?arbitration.

How Much Does it Cost?

Recently I was asked how much it costs to homeschool.? How long is a piece of string?? This is quite a difficult question to answer.? Probably the best way is for me to explain what we spend our money on.

Firstly, I should share some background information with you:
~ We are registered to homeschool with the Qld Government, so do not use a distant education provider.
~ I do not keep an exact record of how much I have spent on what.? Maybe I should?
~ During our first year of home educating I went slightly ?crazy? buying all sorts of curriculum?barely use any of it now.? I believe this was a stage I needed to go through to get where I am now.
~ Due to my kids interests, many of the gifts that I buy them can be classed as ?educational?. {Science kits, craft supplies, board games, logic puzzles, construction toys, books etc.}? I don?t really see these as an educational expense as they were given as gifts.
~ We live within our means.? There are many resources, activities and experiences that I?d love to share with the kids, but I also need to watch my spending.? I make the most of free events, the library, second-hand shops, sales, parks, day-to-day life etc.
~ I am home educating 3 children.? When I purchase resources I always keep in mind that they will be used by most, if not all, the kids at some stage.? Sometimes I divide the cost by 3 to get a better idea of home much I?m spending on each child.

Our Expenses

Outsourced Activities:
~ Weekly dance, swimming and piano lessons.
~ Art workshops.
~ Cricket in summer.
Prior to home educating the kids were already attending dance, cricket and swimming lessons.? The piano lessons and art workshops were included this year as per the kids request.? We have cut down in other areas to accomodate them.

Purchased Resources:
~ Stationery {paper, coloured pens & pencils, manilla folders etc. from Big W during back-to-school sale}
~ Art & craft supplies {craft bits & pieces, paints, brushes, joining materials etc. from Big W or cheap shop}
~ Science kits {Ein-O purchased from Toy Outlet}
~ Books {mostly ?how to?s? from the Book Depository or Second-hand book shops}
~ Construction toys & manipulatives {Fishpond or Toy Outlet}
~ Board & card games, puzzles {Big W, Fishpond or Toy Outlet}
~ Audios {history & classic stories from Book Depository or Peacehill Press}
~ PC games {online or Harvey Norman}
~ Magazine subscriptions & purchase a newspaper weekly {we like to provide the kids with a selection of reading materials}
~ Internet connection
~ Printer toner {Office Toner}
At the moment I am not purchasing any curriculum.? We have plenty of texts to refer to, however I find the internet or library a more useful resource.? Also I always try to make resources from what I have on hand.

Out & About:
~ Museums, zoos, theatre productions, various workshops, galleries, library activities, festivals, markets, theme parks, fishing & camping trips etc.
We aim to incorporate many learning experiences {free & paid} into the kid?s days.

Hidden Expenses:
~ Obviously I do not work.? So in most home educating families a second income is forfeited.
~ Higher electricity and water bills.? If you are taking your child out of school, then you will probably notice an increase in these bills as they are spending more time at home.
~ Possible increase in car expenses.? We do a fair bit of travelling for the kids to attend certain events.

Every family income, wants and needs are different.? It?s hard to put a dollar value on it.? I know one mum who budgets $250 per child per year and another $2000 per child per year.? At a ?guestimate?, we?d probably spend the equivilant of paying for the kids to attend the local church school.? However that includes all the kids ?Outsourced Activities? and ?Out & About? experiences.

The time we spend together as a family is priceless!

Legal Writing Professors' Letter to Yale Law School Administration

? SEALS v. AALS | Main

Legal Writing Professors' Letter to Yale Law School Administration

Late last week, legal writing professors and others sent a letter to the Yale Law School Administration concerning a post on the Yale Law School admissions blog.? I have set out the letter below, with permission of Lisa McElroy, who?spearheaded our efforts.? We owe our deepest thanks to Lisa, Kris Tiscione, and Amy Vorenberg for drafting the letter.? We also owe our thanks to the many deans, associate deans, and doctrinal profesors who signed the letter.??About 450 legal educators signed the letter.

Dear Dean Post and members of the Admissions Committee:

As professors at law schools across the country, we write to address a blog post by Associate Dean Asha Rangappa (see P.S.B.C.: Back by Popular Demand (June 9, 2011), available at http://blogs.law.yale.edu/blogs/ admissions/archive/2011/06/09/back-by-popular-demand.aspx). The post observes that potential transfer students make the "common mistake" of submitting one of two required recommendations from a legal writing "instructor." Although "a third letter from a legal writing instructor is fine," the Committee prefers recommendations from "core subject area professors, who can speak to [a student?s] ability to keep up with the subject material, contribute to class discussion, and think through difficult concepts."

If the post represents the policies or preferences of the Yale Law Admissions Committee, many of us are concerned it sends a message that legal research and writing ("LRW") courses are not rigorous, underestimates the ability of LRW faculty to comment on students? cognitive skills, harms students by discounting the valuable and thoughtful insight we have to offer about students seeking to transfer to Yale, and devalues LRW professors as a whole. To the extent the advice you provide as a top tier school might be interpreted as applicable, or preferable, to a wider law school audience, we feel the statements lacking in appropriate evidentiary support need correction.

Every year, the Legal Writing Institute and the Association of Legal Writing Directors? the two professional organizations for LRW professors and those interested in the discipline? survey a number of ABA-accredited and provisionally accredited law schools that grant the Juris Doctor degree. One hundred eighty-four of the 200 schools surveyed responded to the 2012 survey. At least 170 of those schools require LRW in the first year and award four or more credits for a year-long course. One hundred sixty schools grade the LRW course and incorporate the grade into the students? overall GPA. As the survey indicates, the post?s characterization of LRW as other than a "core subject area" class is inaccurate.

The Committee may be unaware that the typical LRW course requires students to conduct research on complicated legal questions, engage in complex legal analysis, communicate well orally and in writing, conference regularly with their professors on their performance, and behave both ethically and professionally. Accurate, in-depth legal analysis and reasoning are at the core of an LRW course.

The notion that LRW is not a core subject area class is also inconsistent with current thinking about legal education. Consider, for example, the 2007 Carnegie Report, which emphasized the importance of legal writing classes, as well as Justice Kennedy?s statement this week to the Ninth Circuit Judicial Conference: "[L]aw schools are questioning whether or not they are teaching students the right way, and it seems to me that the bench and the bar can engage in serious discussions with the law schools to advise them whether or not, say for the next 20 years, that [sic] they have the proper approach for teaching those who will soon be the trustees of the law as active practitioners. That is urgent."

Given the small size of LRW classes; our knowledge of individual students; and our familiarity with their class participation, writing, oral skills, and personality, we have a unique perspective on our students? abilities at any given time. Here too, the assumption that we are not in the same position as a Property or a Contracts professor to comment on their ability to "keep up," "contribute to class discussion," or "think through difficult concepts" is inaccurate.

We recognize the primary mission of the Committee is to admit students who can compete at an elite institution. Nevertheless, discounting recommendations from LRW faculty could deprive potential transfer students of critical faculty input. LRW faculty often know 1L students the best in terms of what matters most ? their achievement, motivation, raw talent, analytical skills, ability to communicate effectively, and measured progress. Because the post reaches a far wider audience than those students who will eventually matriculate at Yale, we are concerned about the extent to which it suggests that the Yale Law faculty considers LRW professors to be lesser faculty in some sense, passing onto the next generation of law students a bias that LRW and its faculty are not worth their time, attention, or care.

For these reasons, we urge you to reconsider your practice of discounting recommendations from LRW faculty and welcome them as informed and reliable accounts of the transfer students you might soon welcome at your door. We also respectfully request that you amend the post in question accordingly.

As legal educators, we all share the goal of offering the best legal education possible to our students. Our purpose here is to clarify the contribution LRW professors make toward achieving that goal. We thank you in advance for your consideration of this letter.

Sincerely,

Signatures

(Scott Fruehwald)
