Should You DIY Your Own Living Trust? - Washington Estate Planning

The trouble with do-it-yourself planning is
that even if your situation seems simple, there are many oddball things a
layman wouldn?t think of that can go wrong, especially with wills and trusts.

No one wants to pay for
something he or she can do themselves. Right? Refinishing your deck may be one
thing, but preparing your own estate plan may be a horse of a completely
different color.

Forbes addressed this matter last month in an article titled ?What Could Happen If You Write Your Own
Living Trust?
? As the title suggests, estate planning is not a DIY
project to take lightly and the article recounts several ?horror? stories of
layman-driven estate planning gone awry. I recommend reading the article, if
this is a project you are considering.

Admittedly, whenever an estate
planning attorney sounds the alarm against DIY estate planning, he or she runs
the real risk of coming across as self-serving. I get that. Nevertheless, your
estate plan is not your deck. No, your estate plan is the legally binding
roadmap to protect everyone you love and everything you have when you cannot.
Period.

If you botch the deck project,
there usually is a fix. In a worst case scenario, you re-sand and re-stain
(perhaps with a darker stain). If you botch your estate plan, on the other
hand, your minor children may not be reared by the guardians (backup parents)
of your choosing, may squander or lose their inheritance, and your spouse?s
next spouse may take it all anyway. The list goes on.

Additionally, if you botch the
estate plan, to whom will your loved ones turn for relief when you are gone?
Unless you carry ?errors and omissions? insurance, no one.

With many of life?s DIY
projects, life will go on for your loved ones regardless. When it comes to your
estate plan, however, is it really worth the risk?

There have been previous signs that water existed on the red planet long ago, but the images released Thursday showing pebbles rounded off, likely by water, offered the most convincing evidence so far of an ancient streambed.

There was "a vigorous flow on the surface of?Mars," said chief scientist John Grotzinger of the California Institute of Technology. "We're really excited about this."

The discovery did not come as a complete surprise. NASA decided to plunk Curiosity down inside Gale Crater near the Martian equator because photos from space hinted that the spot possessed a watery past. The six-wheeled rover safely landed Aug. 5 after a nail-biting plunge through the Martian atmosphere. It's on a two-year, $2.5 billion mission to study whether the Martian environment could have been favorable for microbial life.

Present day?Mars?is a frozen desert with no hint of water on its radiation-scarred surface, but geological studies of rocks by previous missions suggest the planet was warmer and wetter once upon a time.

The latest evidence came from photos that Curiosity took revealing rounded pebbles and gravel ? a sign that the rocks were transported long distances by water and smoothed out.

The size of the rocks ? ranging from a sand grain to a golf ball ? indicates that they could not have been carried by wind, said mission scientist Rebecca Williams of the Planetary Science Institute in Tucson, Ariz.

Though Curiosity did not use its high-tech instruments to drill into the rocks or analyze their chemical makeup, Grotzinger said scientists were sure that water played a role based on just studying the pictures.

It's unclear how long the water persisted on the surface, but it easily could have lasted "thousands to millions of years," said mission scientist Bill Dietrich of the University of California, Berkeley.

Curiosity chanced upon the dried-up streambed while driving to Glenelg, an intriguing spot where three types of terrain meet. Its ultimate destination is Mount Sharp, a mountain rising from the center of crater floor, but it was not expected to travel there until the end of the year.

Finding past water is a first step toward learning whether the environment could have supported microbes. Scientists generally agree that besides water and an energy source such as the sun, organic carbon is a necessary prerequisite for life.

While an ancient streambed holds promise as a potentially habitable environment, scientists don't think it's a good place to preserve the carbon building blocks of life. That's why the rover will continue its trek to the foothills of Mount Sharp where there's a better chance of finding organics.

Kansas signs hoops coach Self to $3.8M contract

(AP) ? Bill Self could be roaming the sideline at Allen Fieldhouse well into the next decade.

The Kansas basketball coach agreed to a restructured contract Friday that extends through the 2021-22 season and includes a raise to $3.857 million per year. Self's previous deal, worth $3.376 million annually, would have run through June 2018.

Self is coming off his second appearance with Kansas in the Final Four. He led the Jayhawks to the 2008 national title and lost to Kentucky in the championship game in April.

"I know there are a lot of great jobs out there, but I certainly don't think it takes long to call roll for the best of the best, and I'm fortunate to have one of those," Self said. "I can't imagine myself coaching anywhere else as long as the people at Kansas want me to be here."

Self's new contract includes bonus provisions of $50,000 for conference regular-season titles, $25,000 for winning the conference tournament, $100,000 for earning AP coach of the year, $150,000 for reaching the Final Four and $200,000 for winning the national championship.

"I felt great about my previous contract that we redid in '08, and of course, extending it four more years is terrific," Self said. "I don't know if it's anything I'm going to be giddy about or lay awake thinking, 'Hey, I have a contract through 2022.' Hopefully if you're doing a good job, they'll want you around, and if you don't do a good job, they won't want you around."

The restructured contract includes a retention bonus of $876,000 per year, payable in 2015 and 2018. The bonus is replaced in 2019 by an agreement to pay Self a one-time sum of $6 million if he remains the Kansas coach through March 2022.

"We believe Bill Self is among a very small number of elite basketball coaches in this country, and this ensures that we compensate him accordingly," Kansas athletic director Sheahon Zenger said. "We are thrilled that he will remain our coach for at least another decade."

The Jayhawks have won a record eight consecutive Big 12 regular-season titles under Self, and averaged 29.9 wins per year. They have not been seeded lower than fourth in nine NCAA tournaments, and have made six trips to the round of 16 and five appearances in the Elite Eight.

"Bill Self not only wins, but he wins the right way," Kansas Chancellor Bernadette Gray-Little said. "He emphasizes the importance of players being both students and athletes, and is himself an active contributor to the university and community. Bill is an outstanding coach and ambassador."

Despite losing All-American forward Thomas Robinson to the NBA draft, and senior guard Tyshawn Taylor and several other key pieces from last year's national runners-up, Kansas is still expected to be ranked in the top 10 when preseason polls are released.

The Jayhawks return shot-blocking center Jeff Withey, senior guards Travis Releford and Elijah Johnson, and role players Kevin Young and Naadir Tharpe. They'll be helped by one of the nation's top recruiting classes, headlined by Kansas high school standout Perry Ellis.

Also eligible this season will be Ben McLemore and Jamari Traylor, a pair of highly regarded recruits who were forced to redshirt last season because of issues with their academics.

"The key to our team," Self said, "will be how quickly our young guys come around. We have a bunch of them. How aggressive they are, and if they understand the type of aggressiveness and attitude you have to win at this level, at a high level."

Self also dealt with some staff turnover in the offseason.

Assistant coach Danny Manning left to take over the program at Tulsa, where Self once served as coach, and director of basketball operations Barry Hinson was hired to coach Southern Illinois.

Former St. John's coach Norm Roberts has returned to Self's staff as an assistant coach after serving in the same capacity last season at Florida. Former Nebraska coach Doc Sadler has replaced Hinson as the director of basketball operations.

"I think one of the great things about coaching is turnover. It's exciting when you have turnover amongst your staff, even if you don't want to lose guys," Self said. "When guys get opportunities, it's because the players have done a good job and performed well."

Stivarga: Advanced Colon Cancer Drug Approved By FDA

Sept 27 (Reuters) - The U.S. Food and Drug Administration on Thursday approved a new drug for advanced colon cancer developed by Bayer AG a month ahead of the agency's expected action date for a decision.
The drug, to be sold under the brand name Stivarga, was approved to treat colon cancer that has progressed after prior treatment or that has spread to other parts of the body, the agency said.
"Someone has clearly lit a fire under the FDA," Sanford Bernstein analyst Geoffrey Porges said of the speedy approval. "We're seeing a fairly consistent pattern of drugs for high unmet needs diseases being approved on an expedited basis."
In pivotal clinical trials, Stivarga - known chemically as regorafenib - modestly extended survival and delayed disease progression. It helped patients live on average 1.4 months longer than those who received standard treatment without the Bayer drug.
The Bayer drug plus standard care also delayed tumor growth for an average of two months compared with 1.7 months for standard care alone.
"Stivarga is the latest colorectal cancer treatment to demonstrate an ability to extend patients' lives and is the second drug approved for patients with colorectal cancer in the past two months," Richard Pazdur, director of the Office of Hematology and Oncology Products in FDA's Center for Drug Evaluation and Research, said in a statement.
In August, the FDA approved Zaltrap, an advanced colon cancer treatment from Sanofi SA and Regeneron Pharmaceuticals.
Onyx Pharmaceuticals Inc is entitled to a 20 percent royalty payment on global net sales of Stivarga under a collaboration agreement with Bayer. The two companies already share the kidney and liver cancer drug Nexavar.
Porges, Bernstein's biotechnology analyst, called the Onyx royalty agreement, "a fairly attractive deal."
But he said initial sales expectations for Stivarga are relatively modest "because this is really a relatively small indication late in the disease."
Sales forecasts would rise considerably if Bayer were to later gain approval for the drug's use as an initial treatment for colon cancer.
Stivarga is a pill that works by blocking several enzymes that promote cancer growth.
The drug was reviewed under the FDA's priority review program that provides an expedited six-month review for drugs that offer major advances in treatment or that provide treatment when no adequate therapy exists. A decision had been expected by Oct. 27.
The Stivarga label will include a warning that severe and fatal liver toxicity occurred in some patients treated with the medicine during clinical studies, the FDA said.
In addition to Zaltrap, Stivarga will likely also compete with Roche Holding AG's multibillion-dollar cancer drug Avastin and Erbitux from Bristol-Myers Squibb Co and Eli Lilly and Co.
An estimated 143,460 Americans will be diagnosed with colorectal cancer, and 51,690 will die from the disease in 2012, according to the National Institutes of Health.

I'd like to call this, "This ain't your momma's motherhood".

I'm older than a lot of new moms - 38 - but times have changed A LOT since my mom had babies. ?I think the basics are still the same - nurturing, loving, caring for your child but things are done so differently. For example - I think I rode in a car seat but it's possible I didn't and I for sure wasn't rear faced for two years. Or even one year. ?Car seats were not a standard law for the first six years. In fact - my brother and I rode in the WAY back of the station wagon as young kids. I'm not condoning that - I'm so thankful for safety - but it's just funny how times have changed.

Babies also used to sleep on their tummies from day one. Now moms would freak rather than put their babies on their stomachs. And rightly so. Back sleeping is recommended. Our moms didn't have diaper genies or bottle warmers. There were no Boppy's or Bumbo's.

I have my Baby Book and I almost died when I saw what the doctor gave my mom as a recommended solid food schedule. Now doctors will tell you to wait until six months to begin solids and even then it's rice cereal and then veggies and then fruits. My doctor had me on MEAT by three months. MEAT. Can you imagine giving your three month old some chicken?

When I was a baby they didn't have the percentage growth charts either. I think a lot of us moms get worried if our baby is below 10% or like mine - above 95%. I think we can get caught up in what's normal or not normal when children often will average out at a certain age.

Breast feeding wasn't really encouraged back in the 1970's and now it seems to be strongly encouraged. I feel like it has been flipped since my generation. The mom wars have always been around but they have changed.

First couple offer glimpse of their marriage on 'The View'

President Barack Obama and First Lady Michelle Obama appeared on "The View" on Tuesday, giving Americans a glimpse of the first couple's relationship.

"I told folks I'm supposed to be eye candy for you guys," President Obama, flanked by Michelle and the show's five female hosts, joked on the show, which was taped on Monday in New York ahead of his appearance at the United Nations general assembly.

Michelle Obama said she didn't realize that the first presidential debate is on the same date as their 20th wedding anniversary.

"I forgot," the first lady said.

"That's cold," President Obama said.

"I like lavishing her with all kinds of attention when she deserves it," President Obama said when asked how he is as a husband. "And she always deserves it."

The chat fest did eventually turn to more serious subjects, including the economy, Libya and President Obama's opponent in November.

"Would it be disastrous for the country if Mitt Romney were elected?" Barbara Walters asked the president.

"I think America is so strong, and we've got so much going for us that we can survive a lot," Obama responded. "But the American people don't want to just survive, we want everyone to thrive. We want folks to have a shot at success, and so the question then just becomes, whose policies are more likely to lead us to where we want to go?"

The president was also asked what his post-presidential plans are.

"Well, you know, first things first here," Obama quipped. "There's all kinds of things I want to do in the second term, uh, putting folks back to work, making sure our schools are up to snuff."

"And then?" Walters asked.

"You know, in a post-presidency, the thing that I think I would enjoy most is spending time working with kids," Obama said. "I love teaching, I miss teaching, and you know, I'm not sure it would necessarily be in a classroom, but the idea of being able to go around in various cities and helping to create mentorships, and apprenticeships, giving young people the sense of possibility and opportunity, and using whatever spotlight I can shine to show how much incredible talent there is out there."

As for Michelle, President Obama said "she should run for office, but she says she doesn't want to."

"I mean, Michelle would be terrific," he continued, "but temperamentally I just don't think [she could]."

"Yeah, no," the first lady said. "It takes a lot of patience to be the president of the United States, and I'm not that patient."

CAIRO (AP) ? Amid outrage sparked by perceived insults to Islam, one Egyptian newspaper has decided to fight cartoons with cartoons.

Al Watan daily says it is responding to the crude caricatures published last week by a satirical Parisian weekly in kind: a series of sketches critiquing relations between the Arab world and the West.

The paper says they are a "civilized" alternative to the violent protests across the Muslim world sparked by a low-budget anti-Islam film produced in the United States.

"Nothing cracks cartoons but cartoons," said the banner splashed over the two-page spread published this week.

One drawing, captioned "Western glasses for the Islamic world," features a pair of eyeglasses framing the burning World Trade Center towers. Another shows a flashlight wrapped in an American flag pointed at a picture of an angry turbaned man with a knife, ignoring a peaceful Muslim.

Both seem intended to suggest that the only image seen by Western audiences of the Muslim world was that of terrorism.

The newspaper's decision comes amid a debate over freedom of expression in both Muslim and Western countries over the reaction to the film "Innocence of Muslims." Over 50 people have been killed in violence linked to the video over the past two weeks. In Egypt, protesters breached the U.S. Embassy.

Last week, the provocative French magazine Charlie Hebdo published a set of crude cartoons playing off the film and ridiculing the violent reaction to it.

President Barack Obama and other Western officials have condemned the film, but said that no speech justifies the violent response.

Mohamed El Barguti, an editor at Al Watan, told The Associated Press on Wednesday that the cartoons were a "model of a civilized reaction to all that has happened." The paper published the drawings to show that "burning and killing" is not the proper response to insults to Islam, he said.

Schwarzenegger memoir includes "failures" over love child

LOS ANGELES (Reuters) - Arnold Schwarzenegger says his estranged wife has not read his upcoming memoir in which he discusses the secret child he fathered with a family housekeeper.

But in a TV interview with CBS program "60 Minutes," the action star turned politician said he was determined to write a book that included what he called his "failures" as well as his successful and multi-faceted career.

Schwarzenegger's book "Total Recall: My Unbelievably True Life Story," is to be published on October 1.

Publisher Simon & Schuster has said the former California governor began writing it before the May 2011 scandal over the son he fathered years earlier with his housekeeper while married to Maria Shriver.

The revelations led the couple to start divorce proceedings ending their 25-year marriage, and brought media ridicule for the "Terminator" star.

In an interview with "60 Minutes," to be broadcast in full on September 30, journalist Lesley Stahl asked Schwarzenegger, 65, if Shriver knew he was writing about the affair in his book.

"I think that Maria is, you know, wishing me well with everything that I do," he replied, in an excerpt shown on Monday on breakfast show "CBS This Morning."

While admitting that Shriver had not read the memoir, Schwarzenegger continued, "She knows that it's about my whole life and that I would not write a book and kind of leave out that part and make people feel like, 'Well, wait a minute. Are we just getting a book about his success stories and not talk about his failures?' And that's not the book I wanted to write. I wanted to write about the book about me. Here's my life."

According to an advance copy obtained by the New York Daily News, Schwarzenegger writes that he and housekeeper Mildred Baena had sex in 1996 in a guest house at the mansion he shared with Shriver while she and their children were away on vacation.

He was finally forced to admit he was the father of Baena's son in a couples counseling session with Shriver the day after he ended his term as California's governor in January 2011.

The Austrian-born former body-builder, who became one of Hollywood's biggest movie stars, is promoting the book on his official website with a video and the tagline, "This story you know. Are you ready for the story you don't?"

Ingredients

  • juice of 2 limes
  • crispy fried onions
  • 2 tsp fish sauce
  • garlic, finely chopped
  • 1 palm sugar
  • 1 birds-eye chilli, finely chopped
  • dried shrimps, finely chopped
  • green mango, finely sliced
  • red onion, finely sliced
  • basil, sliced
  • mint, sliced
  • peanuts, chopped
  • fresh herbs

Step 1: Make the Dressing

Squeeze out the juice of 2 limes into a bowl. Add finely some chopped garlic, 2 tsp fish sauce, 1 tbsp palm sugar, 1 finely chopped birds eye chilli. Stir until all the sugar has dissolved.

Step 2: Gather the Other Ingredients

Add some sliced green mango to a separate bowl, add your sliced dried shrimps, some finely sliced red onion, sliced basil and sliced mint.

Step 3: Put It All Together

Mix the salad together. Add your dressing. Finish with some chopped peanuts, crispy fried onions and a dash of some fresh herbs on top.

Top Chinese official visits Afghanistan in a rare visit

A top Chinese security official has made a surprise visit to Afghanistan, the first leader from the country to do so in nearly half a century.

Zhou Yongkang, a member of the Standing Committee of the nine member Political Bureau of the ruling Communist Party of China (CPC) Central Committee, arrived at Kabul yesterday.

In Kabul, Zhou held a meeting with Afghan President Hamid Karzai.

"It is in line with the fundamental interests of China and Afghanistan to strengthen a strategic and cooperative partnership, which is also conducive to regional peace, stability and development," Zhou was quoted as saying in a written statement released by the Chinese delegation upon his arrival.

Zhou said the Chinese government fully respects the right of the Afghan people to choose their own path of development and will actively participate in Afghanistan's reconstruction.

The four-hour visit had not been announced by Beijing due to security concerns, state run Xinhua news agency reported.

It followed a two-day trip of Zhou to Singapore, where he met Singaporean leaders on bilateral ties.

It marked the first time in 46 years that a Chinese leader set his foot on the soil of Afghanistan, a war-torn country neighboring China.

The last visit was made by late Chinese leader Liu Shaoqi in 1966 when he was the President of China.

China and Afghanistan established diplomatic relations in 1955.

Zhou's visit considered significant as China, a close ally of Pakistan look to make strong investments in the Afghanistan to build its strategic interests there.

(AP) ? The world's leaders are gathering in New York, but President Barack Obama has no plans to meet privately with any of them.

He will make time for "The View," a freewheeling TV talk show more likely to reach voters than Obama would with the diplomacy he is skipping at the United Nations.

Just six weeks until the election, the realities and priorities of campaign politics hang prominently over Obama's final turn on the world stage before facing voters.

Unlike his predecessors, he is skipping the face-to-face meetings with counterparts where much of the U.N. works gets done, leaving Secretary of State Hillary Rodham Clinton to pick up more of those sessions herself.

Obama's itinerary on Monday and Tuesday is compressed so that he can get back to campaigning in some of the most contested states such as Ohio and Virginia.

Obama's address to the U.N. General Assembly, while avoiding any references to Republican rival Mitt Romney, will be viewed in more of an election context by many observers. Those include the more than 130 heads of state and government who are keenly interested in who will be in the White House next year.

Obama's two worlds will collide in his speech Tuesday. He will have a chance to distinguish his world vision from Romney's at a time when foreign crises have intruded in an election focused primarily on the economy.

Obama campaign officials privately welcome the imagery of the president commanding the U.N. stage and making his case about a stronger U.S. position in the world. But the speech is less anticipated this year, seeming also to be squeezed into a pursuit of a second term built more on domestic concerns.

Obama is expected to explain, explore and defend U.S. engagement in the world as anti-American rage has run high in many nations, fueled by anti-Muslim film that was made in the United States but unconnected to and denounced by Obama's administration.

More than 40 people, including the U.S. ambassador to Libya, have been killed in violence linked to the protests over the film, raising hard questions about the transitions to democracy in the Middle East and North Africa.

The upheaval roiled the presidential campaign when Romney accused Obama's administration of sympathizing with those who attacked U.S. interests.

At the U.N., Obama will try to differentiate himself from Romney by projecting a less aggressive tone toward the world, while also defending America and not seeming like an apologist, said Shibley Telhami, a Middle East scholar and senior fellow at the Brookings Institution.

"That's a tough mix," he said.

The president has previewed his U.N. themes in campaign events, declaring that U.S. will stick with diplomacy but demand returns for Arab partners.

"My message to the presidents of Egypt, Libya, Tunisia and these other countries is, we want to be a partner with you," Obama said. "We stand on the side of democracy. But democracy is not just an election. Are you looking out for minority rights, are you respecting freedom of speech, are you treating women fairly?"

Part of the world is on fire as Obama gets to the United Nations, as is the case each year for all presidents. He will be followed not just by the successes he likes to mention, such as the receding tide of U.S.-led wars, but by a Syrian conflict that has stymied the Security Council and by tensions with ally Israel over confronting Iran.

This time last year, with Mideast peace at the forefront, Obama's schedule was packed with personal diplomacy. He set up separate meetings with the leaders of Israel, the Palestinian Authority, Afghanistan, Brazil, Turkey, Japan, Britain, and France, among others. This year, not one is scheduled.

"I think his engagement with foreign leaders has been, and will continue to be, extremely robust," said White House spokesman Jay Carney. "His attendance at (the U.N. General Assembly) is in keeping with attendance by past presidents engaged in a re-election campaign, and we'll be there overnight in New York."

Both Presidents George W. Bush in 2004 and Bill Clinton in 1996, though, held a series of meetings with foreign leaders during U.N. visits in their re-election years. The Obama White House opted not to jam in a few and risk offending the allies who were left out, administration officials said.

Instead, the secretary of state will see the presidents of Afghanistan, Pakistan, Libya, Tunisia, Yemen and Myanmar as well as the king of Jordan and Israeli Prime Minister Benjamin Netanyahu. Those meetings will be critical to Obama's foreign policy as Washington deals with the withdrawal of troops from Afghanistan, the fallout from the Arab Spring and a delicate time in U.S.-Israeli relations, as officials in Israel continue to speak of a military strike on Iran.

Domestic politics bookend Obama's trip.

When he gets to town, Obama will join his wife, Michelle, on the set of ABC's "The View," where his appearance in 2010 drew a television audience of roughly 6.5 million people. The president's final business in New York will be to speak at Bill Clinton's global initiative ? just a few hours after Romney does the same.
